Terms of Service — Happy Name Day

These Terms of Service (“Terms”) are an agreement between you and Bingkil (“we”, “us”, “our”) governing your use of the Happy Name Day mobile application (the “App”).

By downloading, installing or using the App you accept these Terms. If you do not accept them, do not use the App.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use. This licence is granted under these Terms and, where applicable, under the rules of the store you downloaded the App from.

We retain all rights not expressly granted to you.

2. What you may not do

You may not:

  • copy, distribute, sell, rent, sublicense or otherwise make the App available to others;
  • reverse engineer, decompile or disassemble the App, except to the extent that applicable law expressly permits it despite this restriction;
  • remove or alter any copyright, trademark or other proprietary notices;
  • use the App in any way that breaks the law or infringes anyone’s rights.

3. Name day data is provided for general information

Name day calendars differ from country to country, and sometimes between sources within the same country. Regional traditions, calendar reforms and differing name spellings all mean that no single list is definitive.

The name day information in the App is offered for general interest and convenience. We make no promise that it is complete, accurate or authoritative for any particular country, region, church or family tradition, and you should not rely on it for anything important.

4. Notifications are best-effort

If you enable daily notifications, they are scheduled by your device’s operating system. Operating systems routinely delay, batch or suppress notifications for reasons outside our control — battery optimisation, focus and do-not-disturb modes, forced app closure, low storage, or the device being switched off.

We therefore cannot guarantee that any given notification will be delivered, or delivered on time. Please do not rely on the App as your only reminder for anything that matters.

5. Feedback

If you send us feedback, suggestions or bug reports, you grant us the right to use them freely to improve the App, without obligation, compensation or attribution to you. Please do not send us anything confidential, and do not send us other people’s personal information.

6. Privacy

The App collects no personal data. Our Privacy Policy explains this in full and forms part of these Terms.

7. Intellectual property

The App, its source code, design, logo, name and content are owned by Bingkil and are protected by copyright and other laws. These Terms give you a licence to use the App; they do not transfer ownership of anything to you.

8. Availability and changes to the App

We may update, change or discontinue the App, or any of its features, at any time. We are not obliged to provide updates, support or maintenance, and we are not liable to you if the App or a feature is withdrawn.

9. Disclaimer of warranties

To the fullest extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or opportunity, arising out of or relating to your use of or inability to use the App.

Where liability cannot lawfully be excluded, our total liability to you is limited to the amount you paid for the App, or EUR 10, whichever is greater.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded or limited. If you are a consumer resident in the European Union, your mandatory statutory rights under consumer protection law are not affected by these Terms.

11. Indemnity

You agree to indemnify us against any claims, losses and reasonable costs arising from your misuse of the App or your breach of these Terms.

12. Termination

This licence applies until terminated. It ends automatically if you breach these Terms, and you may end it at any time by deleting the App. Sections 5, 7, 9, 10, 11 and 13 survive termination.

13. Governing law

These Terms are governed by the laws of the Slovak Republic, and the courts of the Slovak Republic have jurisdiction over any dispute.

If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country in which you live, and you may also bring proceedings in the courts of that country. EU consumers may use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

14. Changes to these Terms

We may revise these Terms from time to time. The revised version takes effect when posted on this page, and we will update the “Last updated” date. If you continue using the App after a change, you accept the revised Terms.

15. General

If any provision of these Terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and us regarding the App.

16. Additional terms for the Apple App Store

This section applies if you obtained the App from the Apple App Store, and takes precedence over anything inconsistent above.

  1. This agreement is with us, not Apple. These Terms are concluded between you and Bingkil only. Apple Inc. is not a party to them and is not responsible for the App or its content.
  2. Scope of licence. The licence in Section 1 is limited to a non-transferable licence to use the App on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts via Family Sharing or volume purchasing.
  3. Maintenance and support. We are solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
  4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
  5. Product claims. We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  6. Intellectual property claims. If a third party claims that the App infringes its intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Contact. Questions, complaints or claims regarding the App should be directed to happynameday@bingkil.com.
  9. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Additional terms for Google Play

If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.
